ABS-CBN questions Temporary Restraining Order

A Temporary Restraining Order (TRO) issued by the Quezon City Regional Trial Court Branch 95 ordered ABS-CBN to cease from airing “damaging” statements against GMA-7 in connection with the ratings manipulation controversy that started late last year.
The court states: “…if the defendants’ [ABS-CBN] continuous airing of the alleged defamatory statements which are now subject matter of a civil complaint in court, will not be restrained, then it may undermine the right of the Plaintiff [GMA-7] to a fair trial and due process.
The court clarifies that the Order only prohibits the release of defamatory statements and not the actual coverage of the court hearing and its developments.

GMA-7 honored the court’s decision and expressed hope that ABS-CBN will now strictly confine all arguments inside the courtroom. They emphasized that a media organization with a broad medium must not take advantage of its capability and means to air its side, especially on matters that are already laid before the proper forum.However, ABS- CBN questioned the court’s decision, arguing for public interest and the media’s responsibility to expose corruption.
“Corruption is a matter of public interest, regardless of where it is found. Thus, whether it be in the executive, legislative, or judicial branches of government, or even the private sector, it is the responsibility of media to expose corruption. All who are liable must be held accountable.”
“The temporary restraining order prohibiting news reports that mention GMA Network, Inc. as the party behind the manipulation of television and radio ratings is a prior restraint that violates ABS-CBN’s constitutionally-guaranteed freedoms of speech and of the press. “
“It grants GMA Network a virtual immunity from accusation. No person or entity has ever enjoyed such a privilege, not even the highest public officers of the land. It is a clear attempt to cover up and suppress information on the ratings manipulation issue. “
“ABS-CBN will take legal action to reverse and set aside the temporary restraining order.”
